Will Congress Mandate Online Data Retention?

According to News.com, Rep. Diana DeGette (D-CO) of Colorado is reportedly working with Rep. Ed Whitfield (R-KY) and Joe Barton (R-TX) to draft a bill that would require ISPs, and possibly social networking sites and search companies, to retain user records for a year or more. The legislation could be introduced as early as this week.
While it's unclear at the moment exactly what language any proposed bill may contain, the topic of data retention took center stage yesterday during a hearing on online child pornography held by the House Energy and Commerce Oversight and Investigations Subcommittee. Members of that subcommittee, including Rep. Bart Stupak (D-MI) and Rep. Whitfield, questioned representatives of Web hosting companies and domain registries about their views on data retention and whether or not their companies should be required to hold on to user records to aide in prosecuting online child porn cases.
